Proposed remake of the Transport Operations (Passenger Transport) Standard 2000

The Transport Operations (Passenger Transport) Standard 2000 (the Standard) expires on 1 September 2010 in accordance with the provisions of the Statutory Instruments Act 1992, section 54. One of the main drivers for the legislation expiry system is to ensure subordinate legislation is regularly and thoroughly reviewed and brought up to date by a public consultation system.

It is proposed to replace the expiring Standard with a new standard. The aim is to develop a new standard which will maintain the relevancy and consistency of subordinate legislation and ensure performance standards keep pace with and support passenger transport throughout Queensland.

The provisions of the new standard will relate primarily to safety matters relating to vehicles, vehicle servicing and operations and as well ensuring safe, reliable services are offered. The new standard will not prescribe offences, fees or charges.

Purpose of this paper

The purpose of this paper is to seek submissions from industry, public authorities, interested groups and persons and the public on the proposal to make a new standard to replace the Transport Operations (Passenger Transport) Standard 2000 which expires on 1 September 2010. Closing date for feedback: 28 September 2009

The Transport Operations (Passenger Transport) Standard 2000 expires on 1 September 2010. A new Standard is proposed to maintain the relevancy and consistency of subordinate legislation and ensure performance standards keep pace with and support passenger transport throughout the State.

The new Standard will relate to safety matters for vehicles, vehicle servicing and operations as well as ensuring safe reliable services are offered.

Passenger safety on public passenger vehicles is a priority for the Government. Only vehicles meeting specific safety requirements may provide a public passenger service in Queensland.

The proposed remade Standard will set out the safety, security and quality requirements operators and drivers have to meet to provide public passenger transport services. These requirements will enable the department to ensure small and large operators and drivers provide a reasonable level of public transport safety and service to public passenger transport users.

The proposed remade Standard will meet the objectives of the Transport Operations (Passenger Transport) Act 1994 and the requirements of the Statutory Instruments Act 1992 ensuring the continued provision of an appropriate legislative framework for safe, efficient and sustainable public transport in Queensland.

Community participation, consultation and feedback are essential tools for sound decision-making. The department actively seeks to collaborate with the general public in transport planning and policy development.

Stakeholders are invited to make submissions about the preparation of this replacement Standard. All comments received will be considered in the development of the proposed new Standard which will be available for public comment prior to being considered by the Government.
