Queensland Rail - legislation ensuring commuter safety

Hi there

Can someone please tell me the legislation (qld) which ensures rail safety for commuters. Does this include people on trains and those in train station car parks?

Try Transport Operations (Passenger Transport) Standard 2010 (the Standard)

I don't think car parks as such are covered. Normal civil law would apply.

Does commuter safety legislation protect passengers from dying of old age whilst waiting for QR train services?

Can you be a bit more specific?

Are you referring to security? maintenance?

This standard only relates to public passenger bus services and the obligations of operators.

I'd be interested to know if it would protect passengers that faint on platforms/trains becuase they haven't had anything to eat  :hg

My main concern is whether the act compensates BCC bus passengers for having to transfer on their journey to the CBD. The residents of Brisbane ought to be properly compensated if they have to deal with the trauma of transferring to another bus, or heaven forbid - those things on rails.
Is it really that hard to run frequent, reliable public transport?

In that case virtually none. As soon as you step outside the station grounds (platforms, platform bridges, station parking, entrances etc) you are on council property which is why the stations are very well lit to comply with OHS/DDA (where available)/CCTV etc (Enough that you can plot railway lines from onboard planes landing at BNE during the night) but outside the station grounds there can be poor lighting and access ie footpaths and street lighting. Dakabin is a prime example of this. You'll find a lot of members here think safety on the platforms/on the trains are very good and have minimal problems using them late at night but walking home or away from the station late at night.... we aren't fans of the safety there.

Criminal Code Act 1899 (Qld)

The State is responsible for your protection from criminal acts.

Common law principles such as the law of negligence will also come into play to the extent you have actually incurred any kind of injury or loss and it can be attributed to QR, the local council, TransLink etc, depending on who is responsible for the particular asset.
