Queensland Rail 2013 Draft Access Undertaking

On 25 February 2013, Queensland Rail withdrew its 2012 draft access undertaking and submitted a new voluntary draft access undertaking (the 2013 DAU) to the Authority for its approval. The 2013 DAU sets out the terms and conditions under which Queensland Rail proposes to provide access to rail infrastructure covered by the undertaking once its current access undertaking expires on 30 June 2013.

Queensland Rail is currently subject to the 2008 access undertaking that the Authority approved for QR Network, as amended to include new tariffs and tariff-setting rules in June 2010.

Under section 136 of the Queensland Competition Authority Act 1997 (the QCA Act), the Authority must consider a draft access undertaking given to it, and either approve, or refuse to approve, it.

On 25 February 2013, the Authority issued Queensland Rail with a notice of investigation, under s.146 of the QCA Act, stating its intention to undertake an investigation.

As part of its investigation of Queensland Rail's 2013 DAU, the Authority invites written submissions from interested parties. Submissions must be received by 5:30 p.m. on 8 April 2013. The Authority will consider any submissions it receives within that time.

From the document: For example, Queensland Rail may refuse to enter into an Access Agreement for non-passenger Train Services that are proposed to stop or operate immediately adjacent to stations or platforms at a time when the station or platform is or may be in use by passenger Train Services or passengers for Train Services.

This occurs all the time, with freight trains parked on crossing loops.  I suppose the crucial word is 'may'.  It doesn't say 'won't'.
